TERMS & CONDITIONS

The version effective as of: 24 April 2022

 

These Terms and Conditions define the scope and conditions of use of the website www.tomasikjaworski.com operated by Tomasik Jaworski Spółka Partnerska Kancelaria Adwokata i Radcy Prawnego with its registered office in Warsaw, including provision of services by electronic means.

I, DEFINITIONS

Terms capitalized in these Terms and Conditions shall have the following meanings:

  • Account -  An individual User Account protected by a password, accessible after the User has provided his/her Access Data.

  • Training - Training organised by TJSP, information about which can be found on the Website.

  • Website - The website www.tomasikjaworski.com/ including all sub-sites belonging to it.

  • Access Data - The User’s login and password for the Account.

  • Login - The e-mail address provided during registration for the Account.

  • User - An adult with full legal capacity who uses the Website. 

  • TJSP - Tomasik Jaworski Sp.p. Kancelaria Adwokata i Radcy Prawnego with its registered office in Warsaw at al. Ujazdowskie 39/4, 00-540 Warsaw, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000495961, NIP: 7010411843.

  • Registration Form - The form in which the data indicated in the Terms and Conditions must be filled in in order to register an Account, subscribe to a newsletter or register for a Training.

  • Terms and Conditions - These Terms and Conditions for providing Services by electronic means.

  • Services - Services provided by electronic means by TJSP.

II. GENERAL INFORMATION

1. Under the Terms and Conditions, TJSP provides Services by electronic means that enable the User to:

a. Create an Account;

b. Register for a Training; 

c. Sign up for the newsletter;

d. Contact TJSP through the "Contact" tab on the Website.

2. The User declares to have full legal capacity and at the same time undertakes to read and accepts the provisions of Terms and Conditions prior to using the Website.

3. Under the conditions set out in Terms and Conditions, the User may use the Website to a limited extent without having to create an Account. Lack of registration procedure does not exclude the liability of the User specified in the Terms and Conditions.

4. TJSP publishes content on the Website that can be viewed by the User without the need to create an Account or subscribe to the newsletter.

5. Part of the Website content is available only for Users with an Account.

6. In order to use the Website, it is necessary to meet the minimum technical requirements:

a. connection to the Internet,

b. having a device with an installed and ready to work web browser which supports HTML5 and PDF format,

c. having cookies and JavaScript enabled in your browser.

7. The User may use the Website, including browsing its content on the terms set out in these Terms and Conditions. 

8. When using the Website, the User may not:

a. provide content of an unlawful or offensive nature.

b. undertake any actions which are contrary to the Terms and Conditions, or which may cause disruption or damage to the Website.

c. interfere with the content posted on the Website.

9. TJSP undertakes to use its best efforts to ensure proper functioning of the Website and its availability 24 hours a day, as well as to ensure that the Services available on the Website are of the highest quality possible.

10. The agreement for the provision of services by electronic means shall be concluded with the User upon proper completion of the Registration Form and setting up of an Account or newsletter subscription.

11. TJSP shall exercise due diligence to provide the Services specified in these Terms and Conditions.  Description of these Services is only an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.

12. TJSP reserves the right to periodical technical interruptions necessary to develop the service and minimize the risk of failure. TJSP shall make every effort not to affect the User's ability to use the Account.

13. TJSP reserves the right to cancel the Services after prior notice to the Users.

III. USER REGISTRATION, ACCOUNT CREATION, ACCOUNT LOGGING

  1. Enrolment in the Training requires User registration and setting up an Account.

  2. Creating an Account is voluntary and free of charge.

  3. The User may create an Account on the condition of completing the registration procedure. To register, the User should select the "Log-In" tab on the Website, where the Registration Form is located. To complete the registration, the User should fill in the Registration Form by providing: an e-mail address and a password, as well as other required data. TJSP indicates which data the User must provide obligatorily, and which data are optional. The User will also be asked to provide the relevant consents:

    1. consent to the processing of such data in accordance with the contents of the GDPR.

    2. acceptance of the Terms and Conditions.

    3. optional consent to the processing of the data for marketing purposes, including to receive commercial information from TJSP and to receive a newsletter. Marketing consents are voluntary and their lack does not affect access to the Account.

  4. After completing the Registration Form, the User will receive an activation link to the e-mail address provided. After clicking on the link, the Account is activated.

  5. Only one e-mail address may be assigned to one Account. If a given e-mail address was previously registered on the Website, creating an Account again is not possible.

  6. The User is obliged to provide truthful data.

  7. TJSP reserves the right to change the functionality of the Account. If these changes do not affect the scope and ways of performing the Services under the Terms and Conditions, the amendment of the Terms and Conditions is not required.

  8. A User Account may be used by one User only. Access to an Account may not be made available to third parties.

IV. USE OF THE ACCOUNT, REGISTRATION FOR TRAINING

1. To log into the Account, the User should provide the Access Data. 

2. The User is obliged to keep the Access Data confidential, not to make them available to third parties.

3. After logging into the Account, the User shall have the opportunity to register for the selected Training dedicated to him.

4. A detailed description of each Training is available on the Website under the tab "Trainings".

5. Information on who the Training is directed to and what is its thematic scope is included in the description of each Training.

6. In order to register for a Training, the User should complete the Training Registration Form by selecting the appropriate Training and providing the required details, i.e. name and surname and e-mail address.

7. After completing the Training Registration Form, a link to the platform where the Training takes place will be sent to the User's email address.

8. The User shall be obliged to provide themselves with appropriate technical equipment with access to the Internet, enabling the User to participate in the Training.

V. NEWSLETTER

1. Subscribing to the newsletter does not require an Account. The User should fill in the Registration Form located on the Website in the "Subscribe to our newsletter" field by providing their e-mail address and Company name and pressing the "Submit" button.

2. Subscribing to the newsletter is voluntary and free of charge.

3. The User may unsubscribe from the newsletter at any time via a link included in any email sent by TJSP.

4. Unsubscribing from the newsletter results in deletion of the provided e-mail address from the TJSP database.

VI. CANCELLATION OF SERVICES

1. The User has the right to terminate the contract for the provision of Services at any time by deleting his/her Account.

2. The User may withdraw from the agreement within 14 days from the date of conclusion of the agreement for the provision of Services without giving any reason and without incurring any costs on this account.

3. The statement of withdrawal should be submitted in writing to the address of TJSP indicated in point I of these Terms and Conditions.

4. TJSP may terminate the contract for the provision of Services with immediate effect if:

a. The User violates important provisions of the Terms and Conditions.

b. TJSP obtains reliable and reasonable information that the Account name is false, contrary to the law or morality, violates personal interests of third parties or TJSP.

5. Termination of the agreement referred to in clause 4 above shall result in the removal of the User's Account.

6. If there is such a possibility, TJSP shall inform the User about the termination of the agreement for the provision of Services and deletion of the Account within 14 days, by sending a message to the e-mail address provided by the User in the Registration Form.

7. TJSP reserves the right to refuse to provide Services to the former User after deletion of the Account by TJSP, resulting from violation of the Terms and Conditions.

VII. FINAL PROVISIONS

1. The Terms and Conditions shall be subject to Polish law.

2. Any disputes related to the Terms and Conditions, including the provision of Services will be settled by the Polish common court.

3. In matters not covered by the Terms and Conditions generally applicable provisions of law shall apply, including the Act on provision of electronic services and the Civil Code.

4. These Terms and Conditions are available in electronic form on the Website at: https://www.tomasikjaworski.com/en/regulamin. 

5. The Terms and Conditions may be amended by TJSP, provided that the updated Terms and Conditions will be made available to the User. The Terms and Conditions are made available to the User:

a. via e-mail to the e-mail address provided by the User through Account or,

b. in the form of an explicit notice on the Website.

6. The User shall have at least 14 days' notice before the amended Terms and Conditions come into force.
